THE WOODLANDS PROBATE LAWYERS

People who have been named executor of an estate can turn to the probate lawyers of Gauntt, Koen, Binney & Kidd, LLP, for guidance through the process of probate and estate administration. We recognize that this is a time for grieving. We allow our clients to focus on being with their families as much as possible while we navigate through the legal processes required to ensure that the deceased’s wishes are properly implemented.

WHAT IS PROBATE?

Technically, probate is the procedure in which a will is found to be valid or invalid. However, the term is currently used more generally to define all aspects of estate administration. In Texas, the probate process generally includes gathering the assets of the deceased, addressing the deceased’s remaining debts, paying the necessary taxes and distributing the assets. The executor or estate administrator is tasked with handling all these issues, typically under the supervision of the probate court and with the help of a probate attorney in The Woodlands.

RESOLVING ESTATE DISPUTES

With emotions running high after the loss of a loved one, it is not unusual for family members to become embroiled in a dispute over the estate. Will contests and trust contests that claim the deceased was not of sound mind when the estate plan was created, or was under undue influence of someone, are common. Our lawyers move quickly to resolve these disputes, whether through negotiation or trial as necessary.
