Texas Personal Injury Cases
In most cases, you have just two years to file a personal injury claim. There are exceptions for injured minor children or someone who is mentally incapacitated. Medical malpractice claims are two years from the date the treatment ended or when the malpractice was uncovered. You have two years from your loved one’s death to file a wrongful death suit. Missing these deadlines will mean you cannot get compensation.
If you were partly at fault for the accident, you can still recover damages if your share of the fault is 50% or less. If you are 51% or more at fault, you cannot recover damages.
